Terms and Conditions of Sale

MINERAL RIGHTS: Purchasers will receive surface rights only. No minerals (including coal or lignite) or mineral rights will be conveyed.

EARNEST MONEY DEPOSITS: An earnest money deposit shall be paid at the signing of a contract of sale, to be deposited in a non-interest bearing escrow account, maintained by a local title company.

TITLE EVIDENCE: Seller shall furnish an Owner’s Title Insurance policy.

POSSESSION: Possession of the property will be delivered to buyer at closing.

SURVEY: Seller will provide a legal description and plat of the property.

TAXES: Taxes for the current year will be prorated.

CLOSING: Closing will take place within 45 days after signing contract.

BROKER/REALTOR PARTICIPATION: A real estate broker/realtor can receive a 3% commission at closing, by showing the property to their client and upon acceptance by Seller, deliver to Seller a signed standard TREC Contract of Sale.
