Luminant released the following response regarding today’s Cross-State Air Pollution Rule proposed revisions by the Environmental Protection Agency.

Luminant filed a request for stay and reconsideration of the rule with the EPA on August 5, 2011. Changes to CSAPR are necessary to correct flaws in the rule and to avoid damaging near-term impacts on Texas jobs, power prices and electric reliability. It is a step forward that the agency has now proposed changes, validating that the rule issued in July 2011 has flaws in its provisions for Texas.

We are in the process of reviewing the proposed revisions and will provide comment to the EPA. Notably, the rule still imposes the same imminent effective date of Jan. 1, 2012.

We will analyze the proposed revisions and develop an implementation plan to meet the revised requirements so that we are ready if the proposed revisions are adopted as final changes to the rule.

We will announce this contingency plan once our analysis is complete.
